Shipping
Most orders are processed and dispatched within 2–3 business days, subject to inventory availability and unless otherwise specified. Once an order has shipped, Winback will issue an email confirmation containing the corresponding tracking information.
Orders shipping within the United States are sent via UPS Ground unless an alternative shipping method is requested and approved. Expedited shipping options may be available upon request and may incur additional charges.
All shipments require signature upon delivery.
Winback does not ship to P.O. Boxes and does not sell or ship to countries subject to U.S. Office of Foreign Assets Control (OFAC) sanctions.
International Orders
All prices are listed and charged in U.S. dollars (USD). Prices do not include customs duties, import taxes, brokerage fees, or other international charges. These fees are the sole responsibility of the customer.
Winback is not responsible for delays caused by customs clearance or international carriers. Currency conversion fees imposed by your bank or credit card provider are not refundable.
Returns, Exchanges, and Restocking
All requests for returns or exchanges must be submitted within 30 days of the invoice date and require prior written authorization from Winback.
Returned products must be in original condition and packaging. All returns are inspected upon receipt. Products that show signs of use, damage, or alteration may not be eligible for credit or exchange.
A restocking fee of up to 30% of the original purchase price may apply to approved returns or exchanges.
Customers are responsible for all return shipping costs. Original shipping and handling fees are non-refundable.
Payment Terms, Interest, and Enforcement Costs
Payment is due thirty (30) days from the invoice date unless otherwise agreed in writing.
Any overdue balance may accrue a late payment fee at a rate of 1.5% per month (18% annually), or the maximum rate permitted by law if lower.
The customer agrees to cover all reasonable costs incurred by Winback in enforcing these terms, including collection costs and attorney’s fees.
Risk of Loss
Risk of loss or damage to products transfers to the customer upon delivery. Winback is not responsible for loss or damage occurring after receipt.
Pricing, Title, and Taxes
Prices are subject to change without notice and do not include applicable sales tax, use tax, customs duties, or other governmental charges. Where required, such taxes will be added to the invoice as separate line items.
Title to products transfers to the customer upon shipment from Winback’s distribution facility. All sales are subject to approval by Winback’s credit department.
Order Acceptance
All orders are subject to acceptance by Winback. Any customer terms that conflict with these Terms of Sale are expressly rejected, and these Terms shall govern.
Assignment
These Terms are for the sole benefit of Winback and the customer and may not be assigned or transferred without prior written consent from Winback.
Limited Warranty
Unless otherwise stated in writing, the warranty period begins on the invoice date. During the warranty period, Winback will, at its discretion, provide a one-time replacement or repair of covered equipment or accessories found to be defective in materials or workmanship under normal, intended use.
This Limited Warranty applies only to products purchased directly from Winback or an authorized distributor and is extended solely to the original purchaser.
The Limited Warranty does not apply in the following cases (including conditions referenced in the applicable User Manual):

Natural wear of accessories

Breakage of the equipment or its accessories

Equipment not used in compliance with the instructions for use

Use of the equipment without conductive cream and/or with a cream different from the one supplied and/or approved by SWIMS AMERICA CORP.

Infiltration of liquids or creams

Damage caused by modification, improper installation, accident, or misuse

Damage caused by unauthorized service or repair
Products returned under warranty are subject to inspection and verification by Winback. Warranty coverage does not include consumables, routine maintenance, or damage resulting from transportation, improper storage, or failure to follow operating instructions.
Except as expressly stated herein, Winback disclaims all other warranties, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.
Entire Agreement
These Terms constitute the entire agreement between the parties regarding the sale of products and supersede all prior agreements or understandings, whether written or oral.
Any modification or waiver must be in writing and signed by an authorized representative of Winback.
Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles.
Any legal action arising out of or related to these Terms shall be brought exclusively in state or federal courts located in Connecticut, and the parties consent to jurisdiction and venue in those courts.
